1. About the Platform
These Terms govern access to the PGONE Construction & Engineering website and, where made available, associated digital-platform or “super-app” functions including service discovery, quotations, bookings, provider listings, messaging, customer accounts and payments. PGONE’s current website primarily provides construction, renovation and engineering information and a WhatsApp quotation enquiry route. Features described in these Terms apply only when actually offered.
2. Operator and Eligibility
The platform is operated under the PGONE Construction & Engineering name in Kulim, Kedah, Malaysia. The registered legal entity name, SSM registration number and full business address must be published here before production launch. Users must be legally capable of entering binding agreements; persons below 18 should use the service through a parent or legal guardian.
3. Services, Listings and Providers
Service descriptions, photographs, indicative timelines and availability are informational and may change. A website enquiry is not a binding accepted quotation. Where third-party providers or merchants are listed in future, their identity, role, prices, service conditions and responsibility for fulfilment should be clearly disclosed. PGONE does not imply that third-party services are its own unless explicitly stated.
4. Quotations, Orders and Contracts
Projects require a written scope of work, site details, itemised pricing where appropriate, milestones, timeline, variation procedure and acceptance by the parties. An order or booking is confirmed only after express confirmation. Written project quotations or contracts prevail over this general website text for project-specific commercial terms where legally permissible.
5. Prices, Payments and Taxes
All applicable prices, charges, taxes, deposits, delivery or service fees, payment methods and estimated delivery or performance times should be disclosed before a transaction is confirmed. Unless stated otherwise, pricing is in Malaysian Ringgit (MYR). Online payments are not currently processed on this demonstration website. If payment functionality is added, payment providers and their applicable terms will be identified.
6. Cancellation, Refunds and Complaints
Cancellation, refunds, rectification and warranty arrangements depend on the accepted project contract and applicable Malaysian consumer law. Users must be shown the applicable policy before paying. Statutory consumer rights are not excluded. Contact us using the details below to submit a complaint; provide your quotation/order reference and a description of the issue. If a marketplace is introduced, a purchaser complaint channel will be provided.
7. Account Security and Acceptable Use
If accounts become available, users are responsible for maintaining accurate account information and protecting their login credentials. Users must not commit fraud, impersonate another person, post illegal or misleading material, misuse others’ personal data, interfere with the platform, scrape it without authorisation or compromise its security.
8. Merchant and Partner Obligations
If provider, distributor, franchise or merchant onboarding is introduced, partners must comply with applicable law, hold required licences, provide accurate SSM/business identity and contact information, disclose full prices and essential service information, honour accepted orders, comply with safety standards and support complaints and recordkeeping. Additional signed partner agreements may apply.
9. Content and Intellectual Property
Website design, branding, text, code and owned images belong to their respective rights holders. You may access content for personal or legitimate business enquiries, but may not copy, publish or reuse protected materials without the relevant owner’s permission. Project photography displayed as placeholders is not evidence of PGONE-completed work.
10. Third-party Links and WhatsApp
The quotation form prepares a message in WhatsApp. Sending the message is a separate action that you control, and WhatsApp processes data under its own policies. External sites, maps, social networks, service providers and payment gateways (if added) may have separate terms and privacy notices.
11. Availability and Liability
We aim to keep information accurate and the website accessible but cannot guarantee uninterrupted access or error-free content. Nothing in these Terms limits liability or legal remedies that cannot lawfully be excluded, including rights under applicable Malaysian consumer protection law. Any additional limitation of liability must be fair and enforceable.
12. Changes and Governing Law
We may update these Terms and will show the revision date. Material changes affecting paid orders should be communicated appropriately and cannot retroactively remove accrued statutory rights. Malaysian law governs these Terms, subject to any non-excludable consumer rights and the jurisdiction of competent Malaysian courts.
